Terms of Service

Welcome to Nodera. These Terms of Service ("Terms") govern your access to and use of the Nodera website, applications, and services (collectively, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Nodera is currently offered as a closed beta. Features may change, break, or be removed at any time, and the Service is provided on an "as is" and "as available" basis while we build it.

1.Who we are

The Service is operated by the individual or team behind Nodera ("Nodera", "we", "us", or "our"). You can reach us at any time at nodera-support@googlegroups.com.

2.Eligibility

You must be at least 18 years old to use the Service. Some characters and an optional "Unrestricted Mode" may surface mature or adult themes, and the Service is not intended for minors. By using Nodera you represent that you are 18 or older and that your use complies with all laws that apply to you.

3.Your account

You can browse some content without an account. To publish, sync across devices, and use social features you create an account, including by signing in with a third-party provider such as Google. You are responsible for activity that happens under your account and for keeping your login secure. Notify us promptly if you believe your account has been compromised.

4.What Nodera is

Nodera lets you discover, create, and chat with AI characters. All characters are fictional, and their messages are generated by AI language models. Responses may be inaccurate, inappropriate, or misleading, and do not represent the views of Nodera. Do not rely on AI output for professional, medical, legal, financial, or other important decisions.

5.Acceptable use

You agree not to use the Service to:

break any law, or infringe anyone's intellectual property, privacy, or other rights;
create, solicit, or share content that sexualizes minors, or that depicts real, identifiable people without their consent;
harass, threaten, defame, or harm others, or promote violence, hate, or self-harm;
upload malware, scrape or reverse-engineer the Service, or circumvent security, rate limits, or access controls;
impersonate Nodera or others, or misrepresent your affiliation; or
resell, redistribute, or commercially exploit the Service without our permission.

6.Your content

You retain ownership of the characters, messages, images, and other content you submit ("Your Content"). You grant Nodera a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process Your Content as needed to operate, secure, and improve the Service. You are responsible for Your Content and confirm you have the rights to submit it. We may remove content or suspend accounts that violate these Terms.

7.Credits and purchases

The Service uses virtual credits to access chat, generation, and other features. Credits and any virtual items have no monetary value, are not redeemable for cash, and (except where required by law) are non-refundable. During the beta we may grant, adjust, expire, or reset credits at our discretion. Where paid purchases are offered, they are processed by third-party payment providers subject to their own terms.

8.Intellectual property

The Service, including its software, design, branding, and the "Nodera" name, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

9.Termination

You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access if you violate these Terms, if we discontinue the Service, or to protect users or comply with the law. Sections that by their nature should survive termination will survive.

10.Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI output will be accurate or suitable.

11.Limitation of liability

To the maximum extent permitted by law, Nodera will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. To the extent liability cannot be excluded, it is limited to the greater of the amount you paid us in the three months before the claim or USD $50.

12.Indemnification

You agree to indemnify and hold Nodera harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content or your misuse of the Service or violation of these Terms.

13.Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes may be highlighted in the app. Continued use of the Service after changes take effect means you accept the updated Terms.

14.Governing law

These Terms are governed by the laws applicable in the operator's place of residence, without regard to conflict-of-law rules. Where required by law, nothing in these Terms limits the consumer-protection rights you have where you live.
